These Terms of Service (the “Terms”) govern your access to and use of CandyWrapper—including our websites, mobile applications, and the link- and QR-code-scanning services we provide (collectively, the “Service”). The Service is operated by Danger Close Security Co. (“Danger Close,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

CandyWrapper analyzes URLs and QR-code payloads through a multi-stage security pipeline and returns an informational safety assessment before you visit a destination. The Service may also allow you to create, share, and manage QR codes and view related analytics.

2. Informational Results — No Guarantee of Safety

Security assessments are informational only and are provided on an “as is” basis. A “Sweet” (safe) result is not a guarantee that a link, file, or destination is free of malware, fraud, or other harm, and a “Spoiled” (unsafe) result is not a definitive determination of wrongdoing. You are solely responsible for the links you choose to open and the actions you take.

Threat intelligence changes constantly, third-party data sources may be incomplete or unavailable, and no automated scanner can detect every threat. Always exercise your own judgment.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. Accounts

Some features require an account. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate information and to keep it current.

5. Acceptable Use

You agree not to:

Use the Service to violate any law or the rights of others;
Submit content or links you are not authorized to scan, or that you intend to use to harm others;
Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its infrastructure;
Use the Service to build a competing product, or to scrape or resell our results in bulk without written permission;
Circumvent rate limits, security controls, or usage restrictions.

6. Intellectual Property

The Service, including its software, design, branding, and the “CandyWrapper” name and logos, is owned by Danger Close Security Co. and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of content you submit; you grant us a license to process it solely to operate and improve the Service.

7. Third-Party Services and Destinations

The Service relies on third-party threat-intelligence providers and may reference external destinations. We do not control and are not responsible for third-party services or the websites you ultimately choose to visit.

8. Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DANGER CLOSE SECURITY CO. AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR USD $100.

11. Indemnification

You agree to indemnify and hold harmless Danger Close Security Co. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be communicated where practicable. Your continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which Danger Close Security Co. is organized, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located there, unless applicable law requires otherwise.
